Annette Banda (aka Annette Vink) 50-year-old woman from Salinas, California, who was accused of sexually abusing young boy for years, received a suspended prison term of five years and eight months. She will also be required to register as a sex offender for life and receive counseling. In addition to probation, Banda was sentenced to a year in county jail with good time and actual credits of 288 days.
Monterey County Judge Richard Curtis sentenced her to a suspended prison term of five years, eight months, which will be served on probation. She will serve a year in custody, with 288 days already served, along with counseling, treatment and registering as a sex offender for the rest of her life.
Banda’s sentencing was postponed three times since July, and she completed a California Department of Corrections and Rehabilitation 90-day evaluation to determine if she would be good fit for prison.
“There’s greater success if she was given probation,” Biegel said. “Her psychologists, prison and probation officers, they all recommended probation.”
The victim’s parents, along with the Monterey County District Attorney’s Office, “strongly recommended” prison and objected to any form of probation, assistant district attorney Jeannine Pacioni said.
Annette Banda was arrested in January after her husband discovered a string of emails and texts between her and the boy. Banda’s husband notified the boy’s parent, who then contacted law enforcement. The sexual relationship between mother and teen boy lasted for more than three years, when he was still a minor. Their involvement began in 2010, with most encounters occuring in Banda’s car.
In April, she pleaded no contest to five felony charges, including one count of having unlawful sexual intercourse with a minor.
Family members and friends of both Banda and the victim were present during sentencing. The boy was not present and is attending college in another part of the country.
Those same friends and family wept openly as the victims’ parents told Curtis about the impact the molestation by a once-trusted family acquaintance has had on them and their son.
“My son has suffered. He’s been ostracized,” the father told Curtis. “This is a woman who exhibits total anti-social behavior. We have a penal system in place for people who exhibit anti-social behavior.”
The teen’s mother said she has watched as Vink-Banda blamed abuse at the hands of everyone from her current husband, her ex-husband and boyfriends for her behavior. (She should just admit that she is just another horny MILF who fucks teen boys!)
Prosecutor Jeannine Pacioni told the judge Vink-Banda not only refuses to accept responsibility, but she blames the victim.
“She claims she’s the victim in this situation,” Pacioni says. “She did a remarkable job of grooming this child, buying him fast food, gas cards, giving him a place to hide out…she did a remarkable job of isolating him from his family. She is an ongoing danger to society.”
Defense attorney Larry Biegel noted, “It’s obviously a very sad, tense day for a lot of people.
